There are different legal criteria for submitting eviction notifications based on the type of lease you have. The legal conditions for an eviction notice for a month-to-month tenancy differ from those for tenants with long-term leases (often six months or one year)

Month to Month Lease Eviction Forms

Month-to-month tenants pay rent once a month and the tenancy arrangement continues until either you or landlord decides to stop it. To end a month-to-month tenancy in your first year as a tenant, you and your landlord must exchange written notice. This notice can be given at any time, but it must be given at least 30 days prior to the termination date itself.

A landlord of a month-to-month tenancy may also attempt to evict you with a 72-hour notice for failing to pay your rent in most types of housing. If you haven’t paid your rent within seven days of the due date, you may be in trouble. Notices that specify that your landlord intends to terminate your rental agreement if you don’t pay rent within 72 hours must be included in this form of notice. A court eviction case may be initiated immediately if you do not pay the rent within 72 hours.
