Changes can occur at any time if both parents agree. If the agreement is to be legally binding, it must go before a court and be approved. As long as the agreement isn’t approved by the court, the parents aren’t obligated to obey it.

Is there a reason why a parent might want to alter a custody agreement? Children’s needs change as they grow. They may have problems in school and need to be enrolled in a private education facility that allows for less time spent with the non-custodial parent during visitation.

Another situation is if a kid is injured and requires long-term specialized medical treatment that can only be provided at a facility outside of the state, such as a rehabilitation center.

Two criteria are required for a parent to properly request a change under the regulations of several states:

  • a major change in circumstances warranting a revision in the parenting plan or custody arrangement
  • It is in the children’s best interests to allow the change.
A significant change in circumstances is frequently accompanied by a significant and lasting transformation. If a parent did something to influence this, it cannot be temporary or accidental.
